Terms and Conditions of the Katathani Thai Massage & Spa Online Store

Effective as of 09.04.2026

§ 1. General provisions

These Terms and Conditions set out the rules for using the Katathani Thai Massage & Spa online store, in particular:

  1. the rules for browsing the Store offer,
  2. the rules for placing Orders,
  3. the rules for concluding distance sales agreements,
  4. the rules for making payments,
  5. the rules for delivery of Products,
  6. the rules for purchasing and redeeming Vouchers,
  7. the rules for withdrawal from the agreement,
  8. the rules for submitting and handling complaints,
  9. the rules for the provision of electronic services.

The online store is operated by:

These Terms and Conditions are made available free of charge on the Store website in a manner that allows them to be obtained, recorded, and reproduced.

The Customer is obliged to use the Store in a manner consistent with the law, good practice, and the provisions of these Terms and Conditions.

Information published in the Store, including Product descriptions, prices, and promotional materials, constitutes an invitation to conclude an agreement unless expressly stated otherwise.

§ 2. Definitions

The terms used in these Terms and Conditions shall have the following meaning:

  1. Store, the online store operated by the Seller under the domain katathanispa.pl,
  2. Seller, KATATHANI WAW THAI SPA SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ,
  3. Customer, a natural person, legal person, or organizational unit with legal capacity using the Store,
  4. Consumer, a Customer who is a consumer within the meaning of applicable law,
  5. Business Customer with consumer rights, a natural person conducting business activity who is entitled to consumer rights under applicable law,
  6. Product, a movable item, Voucher, or any other product or service offered by the Seller through the Store,
  7. Voucher, a gift voucher in electronic or physical form entitling the holder to use services offered by Katathani Thai Massage & Spa under the rules set out in these Terms and Conditions,
  8. Value Voucher, a Voucher issued for a specified gross amount,
  9. Treatment Voucher, a Voucher entitling the holder to a specific service or package,
  10. Order, a declaration of intent by the Customer aimed directly at concluding a Sales Agreement,
  11. Sales Agreement, a distance agreement concluded between the Customer and the Seller via the Store,
  12. Business Days, days from Monday to Friday, excluding public holidays.

§ 3. Electronic services

The Seller provides electronic services consisting of:

  1. enabling browsing of the Store offer,
  2. enabling the placement of Orders,
  3. enabling contact with the Seller through the contact details provided in the Store.

Using the Store requires:

  1. a device with internet access,
  2. an up to date web browser supporting standard internet technologies,
  3. an active e-mail address, if required to place an Order or make contact.

The Customer is obliged to:

  1. provide true, current, and complete data,
  2. not provide unlawful content,
  3. not undertake actions that could disrupt the operation of the Store.

Complaints regarding electronic services may be submitted to the e-mail address kontakt@katathanispa.pl. The Seller shall consider them without undue delay, no later than within 14 days from the date of receipt.

§ 4. Placing Orders and conclusion of the Sales Agreement

Orders may be placed through the Store 24 hours a day, subject to technical interruptions and maintenance work.

In order to place an Order, the Customer shall:

  1. select a Product and add it to the cart,
  2. complete the data required to process the Order,
  3. select the payment method and, where applicable, the delivery method,
  4. confirm that they have read these Terms and Conditions,
  5. place the Order by using the button indicating an obligation to pay.

Placing an Order implies an obligation to pay.

The Sales Agreement is concluded when the Customer receives confirmation from the Seller by e-mail that the Order has been accepted for processing.

The Seller may contact the Customer in order to:

  1. confirm the data provided,
  2. clarify doubts regarding the Order,
  3. remove errors preventing proper processing of the Order.

§ 5. Prices and payment methods

All prices presented in the Store are gross prices and are expressed in Polish zloty unless expressly stated otherwise.

The prices of Products do not include delivery costs unless otherwise indicated in the information provided in the Store.

The Customer is informed of the total Order price, including delivery costs, no later than before placing the Order.

The currently available payment methods are indicated in the Store at the stage of placing the Order.

The Seller may use external payment operators.

§ 6. Delivery of Products

Physical Products are delivered to the address indicated by the Customer when placing the Order.

Delivery of Physical Products is carried out by means of delivery methods made available in the Store, in particular via InPost or other delivery methods currently indicated in the Store.

An electronic Voucher is delivered to the e-mail address indicated by the Customer when placing the Order.

The Customer is obliged to provide correct and complete data necessary for processing the Order, including the correct e-mail address and delivery address, where required.

An electronic Voucher is sent automatically to the e-mail address indicated by the Customer after successful payment of the Order.

A physical Voucher and other Physical Products are generally shipped within up to 2 Business Days from the moment the payment is credited.

In the event of delivery problems, shipment damage, or failure to deliver the Order, the Customer should contact the Seller directly.

§ 7. Vouchers

The Store offers:

  1. Treatment Vouchers,
  2. Value Vouchers.

A Voucher may be purchased:

  1. online through the Store,
  2. in person at any Katathani Thai Massage & Spa location.

In the case of purchasing a Voucher online:

  1. the Voucher cannot be collected in person at the salon,
  2. the Voucher cannot be paid for at the salon,
  3. if an electronic Voucher is selected, it is sent automatically to the e-mail address indicated by the Customer during the Order process,
  4. if a physical Voucher is selected, it is delivered via InPost in accordance with the selected delivery method within up to 2 Business Days.

When purchasing a physical Voucher at the salon, the Customer is kindly asked to contact the salon by phone in advance, preferably around 30 minutes before the planned arrival, so that the Voucher can be prepared.

The Voucher is valid for 6 months from the date of purchase.

The Voucher may be redeemed at any Katathani Thai Massage & Spa location.

Redeeming a Voucher requires advance booking of the appointment.

An appointment using a Voucher may be booked by phone or via Booksy.

When making a booking via Booksy, the Customer is required to state in the note for the business that they have a Voucher and provide the Order number or Voucher number. If the Customer makes a booking without providing this information, the Seller has the right to refuse settlement of that visit using the Voucher and request payment in accordance with the current price list or propose a change of the Voucher redemption date.

The Voucher is single use and must be redeemed during one visit unless the Seller expressly decides otherwise.

If the price of the selected service exceeds the value of the Voucher or the scope of the service covered by the Voucher, the Customer is obliged to pay the difference no later than at the time of the appointment.

Any unused part of the Voucher value is not refundable, cannot be reused, and cannot be exchanged for cash.

The Voucher cannot be exchanged for cash.

The Voucher cannot be combined with promotions, discounts, discount codes, or other special offers unless the Seller expressly decides otherwise.

The Customer is obliged to present the Voucher or the data enabling its identification before the service begins.

If it is necessary to change the date of an appointment related to Voucher redemption, the Customer should contact the selected location as early as possible. Each case is considered individually, taking into account appointment availability and the organization of the salon's work.

The provisions of this section regarding validity, redemption rules, bookings, additional payments, single use, and combining Vouchers with promotions shall also apply accordingly to Vouchers purchased in person.

§ 8. Withdrawal from the agreement

A Consumer and a Business Customer with consumer rights have the right to withdraw from a Sales Agreement concluded at a distance without giving any reason within 14 days.

The withdrawal period runs:

  1. for Physical Products, from the day the Customer or a third party indicated by the Customer, other than the carrier, takes possession of the Product,
  2. for electronic Vouchers and other non tangible performances, from the date the agreement is concluded.

In order to exercise the right of withdrawal, the Customer should submit an unequivocal statement to the Seller:

  1. by e-mail,
  2. in writing to the Seller's registered office address.

The Customer may use the model withdrawal form constituting Appendix No. 1 to these Terms and Conditions, but this is not mandatory.

In the event of an effective withdrawal from the agreement, the Seller shall refund all payments received from the Customer without undue delay and no later than within 14 days from the date of receipt of the withdrawal statement.

The refund shall be made using the same payment method that the Customer used unless the Customer expressly agrees to a different refund method.

In the event of withdrawal from an agreement concerning a Physical Product, the Customer is obliged to return the Product without undue delay and no later than within 14 days from the date of withdrawal from the agreement.

The direct cost of returning a Physical Product shall be borne by the Customer.

The Seller may withhold the refund until it has received the Product back or until proof of its return has been provided, whichever occurs first.

The Customer is responsible for any diminished value of the Physical Product resulting from use beyond what is necessary to establish the nature, characteristics, and functioning of the Product.

The right of withdrawal does not apply in cases provided for by applicable law, in particular with regard to:

  1. Products made to the Customer's specifications or serving to satisfy the Customer's individualized needs,
  2. services fully performed with the Customer's express consent, if before the performance began the Customer was informed that they would lose the right of withdrawal after the service had been fully performed,
  3. other performances for which the exclusion of the right of withdrawal results directly from applicable law.

In the event of full redemption of the Voucher, the right of withdrawal expires. In the event of partial redemption of the Voucher, the right of withdrawal does not apply to the extent to which the Voucher has already been used.

§ 9. Complaints regarding Physical Products and electronic services

The Seller supplies Physical Products in conformity with the agreement and shall be liable to the Consumer and the Business Customer with consumer rights for any lack of conformity of the Physical Product with the agreement under the applicable law.

Complaints regarding Physical Products and electronic services may be submitted:

  1. in writing to the Seller's registered office address,
  2. by e-mail to kontakt@katathanispa.pl.

A complaint should include in particular:

  1. the Customer's first and last name or business name,
  2. contact details,
  3. the Order number,
  4. a description of the problem,
  5. the request, if the Customer wishes to specify it.

The Seller shall respond to the complaint without undue delay, no later than within 14 days from the date of its receipt.

If a complaint regarding a Physical Product proves justified, the costs related to the complaint shall be borne by the Seller.

§ 10. Complaints regarding Vouchers and salon services

In the event of problems related to the purchase, delivery, identification, activation, redemption, or settlement of a Voucher, as well as in the event of objections regarding the service connected with its redemption, the Customer may submit a complaint:

  1. in writing to the Seller's registered office address,
  2. by e-mail to kontakt@katathanispa.pl.

A complaint should include in particular:

  1. the Customer's first and last name or business name,
  2. contact details,
  3. the Order number,
  4. the Voucher number, if assigned,
  5. a description of the reported problem.

The Seller shall consider the complaint without undue delay, no later than within 14 days from the date of its receipt.

§ 11. Out of court dispute resolution methods

A Consumer has the possibility of using out of court methods of handling complaints and pursuing claims, in particular with the assistance of:

  1. the competent Provincial Inspectorate of Trade Inspection,
  2. a permanent consumer arbitration court,
  3. a municipal or district consumer ombudsman.

Detailed information on out of court methods of resolving consumer disputes is available on the websites of UOKiK and the relevant public institutions.

§ 12. Personal data

The controller of Customers' personal data is the Seller.

Personal data is processed in accordance with applicable law and in accordance with the Privacy Policy available on the Store website.

§ 13. Final provisions

These Terms and Conditions shall apply from 09.04.2026.

The Seller may amend these Terms and Conditions for important reasons, in particular in the event of:

  1. changes in legal provisions,
  2. changes to the Seller's details,
  3. changes in the functionality of the Store,
  4. changes in payment or delivery methods,
  5. extension or change of the Store offer.

Any amendments to these Terms and Conditions shall not infringe the rights acquired by Customers before the effective date of the changes. For Orders placed before the new version of the Terms and Conditions comes into force, the version applicable at the time of placing the Order shall apply.

Matters not regulated in these Terms and Conditions shall be governed by the applicable provisions of Polish law.

These Terms and Conditions do not exclude or limit any rights of the Consumer or the Business Customer with consumer rights arising from mandatory provisions of law.
